Terms of Service
These Terms of Service ("Terms") govern your access to and use of the FocusFlow AI platform and services ("Services") provided by FocusFlow AI, LLC ("FocusFlow AI," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using our Services, you represent that you are at least 18 years old, have the authority to enter into these Terms on behalf of yourself or your organization, and agree to comply with these Terms and our Privacy Policy.
2. Description of Services
FocusFlow AI provides a property management automation platform that includes email processing, task management, owner and tenant notification workflows, lease tracking, vendor management, and related features. The Services are designed for property management professionals and companies.
3. Account Registration
You must create an account to use our Services. You agree to provide accurate and complete information, maintain the security of your account credentials, notify us promptly of any unauthorized access, and be responsible for all activity under your account.
4. Authorized Use
You may use our Services only for lawful property management purposes in accordance with these Terms. You agree not to:
- Use the Services to send unsolicited communications or spam.
- Upload or transmit content that violates any applicable law or third-party rights.
- Attempt to reverse-engineer, decompile, or extract source code from the platform.
- Use the Services in any way that could damage, disable, or impair our infrastructure.
- Access the Services using automated means not authorized by us.
5. Google API Services
Our Services integrate with Google APIs, including Gmail. By enabling Gmail integration, you authorize FocusFlow AI to access your Gmail account for the limited purpose of processing property management communications. This access is governed by Google's Terms of Service and our Privacy Policy. You may revoke this access at any time.
6. Your Data
You retain ownership of all data you provide to or generate through the Services ("Your Data"). You grant FocusFlow AI a limited license to process Your Data solely to provide and improve the Services. We will not sell Your Data or use it for purposes unrelated to the Services you have requested.
7. Subscription and Payment
Access to certain features requires a paid subscription. Subscription fees are billed in advance on the applicable billing cycle. All fees are non-refundable except as required by law or as expressly stated in your subscription agreement. We reserve the right to modify pricing with reasonable advance notice.
8. Intellectual Property
The FocusFlow AI platform, including its software, design, trademarks, and content, is owned by FocusFlow AI, LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Services as described herein.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FOCUSFLOW AI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOCUSFLOW AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless FocusFlow AI, LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your access to the Services immediately if you violate these Terms or engage in conduct we determine to be harmful to us, other users, or third parties. Upon termination, your right to use the Services ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Kansas.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms on this page. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
